Terms of Service
Effective: May 1, 2026
1. Agreement to Terms
By accessing this website or engaging Upsy Daisy Shaft & Safety Services for any service — including elevator pit and shaft cleaning, water removal and dewatering, general cleaning, room turnover services, and painting — you agree to be bound by these Terms of Service. If you do not agree, please do not use this website or our services.
2. Services Provided
Upsy Daisy Shaft & Safety Services provides professional property services including but not limited to: elevator pit and shaft cleaning and inspection, water removal and dewatering, commercial and residential general cleaning, room turnover cleaning, and interior and exterior painting. All services are subject to written agreements or accepted quotes that constitute the binding service contract between the parties.
3. Quotes and Pricing
Quote requests submitted through this website are non-binding estimates. A binding service agreement is only established when a written quote has been accepted in writing by the client and confirmed by Upsy Daisy Shaft & Safety Services. Quoted prices may be subject to change if actual site conditions differ materially from those described in the quote request.
4. Service Scheduling and Access
Client agrees to provide reasonable access to the property and relevant areas (elevator pits, mechanical rooms, units, painting surfaces) on the agreed service date. If access cannot be provided, reasonable rescheduling fees may apply. Emergency service availability is subject to crew dispatch capacity and is not guaranteed.
5. Safety Compliance
All services are performed in compliance with applicable OSHA regulations, including OSHA 1910.146 for confined space entry (elevator pit work). Client agrees to disclose any known hazards, lock-out/tag-out requirements, or safety restrictions at the property prior to service. Upsy Daisy reserves the right to delay or discontinue service if site conditions present an undisclosed safety risk.
6. Hazardous Materials
If unknown hazardous materials (asbestos, mold, lead paint, biological waste, or other regulated substances) are discovered during service, work will be paused and the client notified immediately. Remediation of hazardous materials is outside the scope of standard services unless specifically agreed in writing.
7. Limitation of Liability
To the fullest extent permitted by law, Upsy Daisy Shaft & Safety Services' total liability for any claim arising from services shall not exceed the amount paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages. Pre-existing property conditions discovered during service are not our liability.
8. Website Disclaimer
This website and its content are provided for informational purposes only. While we strive for accuracy, we make no warranties regarding the completeness or accuracy of any information herein. Use of this website is at your own risk.
9. Governing Law
These Terms of Service are governed by the laws of the Commonwealth of Pennsylvania. Any disputes shall be resolved in the courts of Northampton County, Pennsylvania, unless otherwise agreed in writing.
